Britain's government initiates discussion on crucial tech-related patents to foster technological advancement
The UK government has launched a consultation on standard essential patents (SEPs) and potential measures to address challenges in the licensing ecosystem. This move aims to improve efficiency, transparency, and fairness in SEP licensing, particularly to support small and medium-sized enterprises (SMEs).
The consultation, which is open until 7 October, seeks views on various proposals that could shape the future of the UK SEP ecosystem. Some of the key proposals include:
- Introduction of a Rate Determination Track (RDT)
The government is considering the introduction of a specialist, streamlined litigation track called the RDT. This track is designed to provide quicker, more affordable resolution of disputes regarding licensing rates for SEP portfolios. The rates determined via this track would be published to increase transparency and provide a basis for commercial negotiations.
- Enhancement of Transparency Through Searchable Standard-Related Patent Information
The government is considering supplementing the One Intellectual Property Office (IPO) Search Service by mandating disclosure of information on patents identified as essential at Standard Developing Organizations (SDOs). This would allow users to easily search for and navigate data on standard-related patents, improving information access on patent essentiality.
- Potential Regulatory Measures with a Balanced Approach
While avoiding over-regulation, the government is considering proportionate, targeted interventions that encourage positive behavioral changes in the SEP ecosystem without causing unintended consequences. This includes whether further government intervention is needed beyond the RDT and enhanced transparency measures to tackle information asymmetry and pricing opacity.
The consultation also seeks feedback on various aspects of the proposed measures, such as the methodology to be used in the RDT, the current remedies provided in SEP litigation, and the level of awareness of alternative dispute resolution (ADR) services in the SEP ecosystem.
The UK government's aims include increasing economic growth in the UK through the use of science and technology, with a focus on advanced connectivity technologies. The proposed measures are part of a broader goal to stimulate technology-driven economic growth and innovation in the UK.
