Spilling the Beans: NRW Data Protection Boss Exposes Corporate Shenanigans

Data Guardians in North Rhine-Westphalia discover infractions in various businesses - North Rhine-Westphalia's data privacy watchdogs scrutinize data practices

Straight talking and zero-bullshit, Bettina Gayk, the data watchdog of North Rhine-Westphalia, has been keeping a busy nose in 12,490 complaints last year, almost a carbon copy of the complaints in 2019, as reported in her office's 30th activity report.

What's causing a ruckus? Gayk and her team have been exposing unlawful practices by NRW-based companies. Take, for example, those sneaky insurance firms exchanging sensitive health data like it's last-call happy hour. Plus, a secret emotion recognition software was a no-go for a call center operator in the region.

But it doesn't end there. An online weather service shooting user location data to third parties without proper consent got a firm reprimand from the data protection cops. And guess what? A housing association trying to creep past tenants with climate-monitoring smart smoke detectors in apartments? Yikes! Gayk made it clear that the room temperature tea party should be a big no-no.

Criticism Galore for the Fresh Federal Team

Gayk slammed the new black-red federal government's plans to shift data protection supervision over companies from the state level to the federal level. Current rulebook states that the supervision is handled by the respective state data protection officers. Gayk believes that a change to a federal authority might result in companies losing a priceless, easily accessible consultation.

The top dog in NRW data protection also cautioned against diluting data protection in favor of new security laws. Plans like using AI for facial recognition and granting the constitutional protection access to private video surveillance systems in NRW give her major vibes of ultraviolence. Gayk demanded a firm legal armor for the constitutional protection. We're not all traveling by train with a target on our backs, darling!

Eyes Wide Open on Private Video Surveillance

Tens of millions of people are under the watchful gaze of private video surveillance every day, from public transportation to gas stations, without the security authorities even blinking an eye. If we pile on the suspicion that the constitutional protection lurks behind every private camera, it'll be an overly aggressive violation of personal freedoms.

A Warning from the Boss: Be Careful with Your WhatsApp

Gayk has come across a variety of cases in her 216-page report that flouted data protection guidelines. Be mindful of your WhatsApp usage, warns Gayk, as data processing is often shrouded in mystery. And you better not use WhatsApp to transmit those smart meter readings!

Job centers are also on the radar. If you're asked to dish out your phone number and email address in their online forms, it's a no-go, according to Gayk. That's a straight-up data protection violation.

Unhappy Camper with the Legal Eagle

Gayk's not pleased with the cooperation between her office and NRW Minister of Justice Benjamin Limbach (Greens). The crux of the issue is the blurry control authority of data protection officers with the public prosecutors' offices. Gayk was expecting a clear statement of support, but instead received the opposite. "I find it mighty peculiar that a Minister of Justice would want to stir up such a fuss in my independent control," said Gayk.
